AS USED HEREIN, THE TERMS “YOU” AND “USER” SHALL MEAN ANY VISITOR TO THE WEBSITE, AND/OR CLIENT of contessa concierge & Personal assistant services.

Please read the terms and conditions agreement carefully before accessing or using this website, and/OR USING OUR SERVICES.

You must read, agree with and accept all of the terms and conditions contained in this Terms and Conditions agreement, as well as our Terms of Use Agreement, Privacy PolicyBlog Disclaimer and Commenting Guidelines, where applicable, before accessing, participating in, or using our Sites and Services.

By activating your account, where applicable, and using or engaging the services of Contessa Concierge & Personal Assistant Services, you agree to all of the terms and conditions of Contessa Concierge & Personal Assistant Services "Terms and Conditions Agreement." If you do not agree with any of the terms and conditions contained herein, please do not use or engage the services of Contessa Concierge & Personal Assistant Services. 

You acknowledge and agree that Contessa Concierge & Personal Assistant Services has full right to amend these Terms and Conditions, at any time, by posting the relevant amended and restated Terms and Conditions on our website, available at https://www.contessaconcierge.com and/or providing a revised written Terms and Conditions Agreement to Clients, and such amendments to the Terms and Conditions are effective as of the date of posting. Your continued use of the Services after the amended Terms and Conditions are posted to Contessa Concierge & Personal Assistant Services' website, or provided in writing, constitutes your agreement to and acceptance of the amended Terms and Conditions. If you do not agree to any changes to the Terms and Conditions, do not continue to use the Service. Please check the Terms and Conditions at https://www.contessaconcierge.com from time to time for any updates or changes that may impact you.

This page refers to and covers some of the Terms and Conditions that form the Agreement that Users would enter into with Contessa Concierge & Personal Assistant Services should they decide to engage and use our services. Though not fully comprehensive in scope, it does provide information to users with respect to the general terms and and policies under which we "Contessa Concierge & Personal Assistant Services" operate our business in order to provide services to our clients. This may be useful information if you are an existing user or client, or if you are considering, or will be engaging our services.

Contessa Concierge & Personal Assistant Services reserves the right to make all final decisions on services provided and their related costs.

  1. You must be 18 years or older or at least the age of majority in the jurisdiction where you reside or from which you use this Service.

  2. Contessa Concierge & Personal Assistant Services offers only services that are limited to what is legal, ethical, and considered safe and socially responsible.

  3. All prices are quoted and listed in Canadian dollars.

  4. All prices are subject to change without notice.

  5. Local travel time (City of Toronto) and mileage are included in standard rates, programs and packages, and hourly rates. Note: Exceptions may apply.
    Travel expenses, including but not limited to mileage, outside the City of Toronto will incur additional fees.

  6. Payment options include: bank eTransfer, cheque and cash, unless otherwise indicated, payable to: Contessa Concierge & Personal Assistant Services.

  7. Standard office hours are Monday to Friday 9:00 a.m. to 6:00 p.m.; Saturday 9:00 a.m. to 4:00 p.m.; and Sundays are closed.

  8. We usually require a minimum 48-hour notice for booking service requests. Services are scheduled and performed on a first-come, first-serve basis. We recommend that services be booked in advance to ensure your service request time is met. Same day service and last-minute requests or urgent requests are possible, subject to scheduling, staff and/or resource availability. Rest assured, we'll do whatever it takes to fill last-minute or urgent service requests.

  9. There is a three-hour minimum for hourly billed service requests as well as for most other service requests. After the minimum is attained, rates are billed in 15-minute increments thereafter.

  10. Requests made for a service(s) to be rendered outside of normal business hours will be subject to a surcharge or premium rate, with the exception of certain pre-arranged services such as house sitting, home watch or vacation services, etc. We will advise you in advance as to whether a service requested outside of normal business hours will be subject to the surcharge or premium rate.

  11. Services requested to be fulfilled during Canadian statutory or civic holidays will be subject to a surcharge or a premium hourly rate that will be communicated in advance to the client for their approval prior to booking and/or confirming the service request.

  12. ACCESS TO PROPERTY:
    12.1 If the task or service requested by the Client(s) requires access to a personal, vacation or business residence or property, arrangements must be made in advance to allow Contessa Concierge & Personal Assistant Services access to the property. If, for any reason, Contessa Concierge & Personal Assistant Services cannot gain access to the property, the full charge for the service(s) will be assessed to the client. Clients may choose from a variety of options to arrange for service access to the property, which will be discussed and agreed upon in advance with the client(s) prior to the task or service request being initiated.

  13. PAYMENT METHOD AND TERMS:
    13.1 All monthly or annual or custom programs, packages and plans must be pre-paid in full in advance of the services being rendered. Payment may be made by bank Etransfer, cash or cheque. Payment is payable to: Contessa Concierge & Personal Assistant Services.
    13.2 For à la carte, hourly rates or services, or ad hoc services, or Specialty Services, payment is due immediately upon receipt of invoice for services rendered. For payment, we accept bank eTransfer, cheque, or cash. Payment is payable to: Contessa Concierge & Personal Assistant Services.

  14. MONTHLY AND ANNUAL PROGRAMS, PACKAGES AND PLANS:
    14.1 Programs, packages and plans are available on a monthly or annual basis starting on the 1st of each month, and they must be paid in full on or before the 1st of each month, in accordance with our monthly billing cycle. For example: A newly enrolled monthly personal concierge program that begins on September 1st will be billed/invoiced prior to September 1st, and it must be paid in full on or before September 1st. The same process ensues for subsequent months for the duration of the program, package or plan.
    14.2 You will be billed/invoiced one (1) day prior to the beginning of your monthly or annual program, package or plan each month automatically. Your program, package or plan will renew automatically once you purchase it in writing and agree to these terms. Please note that your program, package or plan will begin from the first of each month and will automatically renew in 30 days. Program, package and plans are set to renew at the beginning of each month, not on the day that you activate your program, package or plan. Please make sure that you provide a current and valid credit card, for which you have the appropriate and current billing address information where fees or charges can be applied. Please notify us in writing immediately if your credit card information changes and we need to update your credit card information on file. Unused hours, credits, and requests are non-refundable, they do not roll over, they can not be banked, accrued or accumulated to the following month, or transferred to a different service package, program, or plan, nor can they be gifted, shared or transferred to a third party.
    14.3 If a client(s) requires or utilizes additional hours or services that are not within the scope of, or that are above and beyond what is included in their current pre-paid package, program, or plan, they can choose to purchase additional services at an hourly rate. They will be handled and quoted separately in consultation with the client. They will be charged at the standard rate for that service request(s), unless otherwise notified, and they must be paid immediately upon receipt of invoice for services rendered.
    14.4 Specialty Services will be subject to a different rate, fee or cost structure.
    14.5 No membership required to use or purchase any of our services, or plans, packages, or programs.

  15. SPECIALTY SERVICES:
    15.1 Due to the unique nature of the Specialty Services we offer and the level of customization involved, please note that Specialty Services will be subject to a different rate, fee or cost structure and are determined on an individual case-by-case basis.
    15.2 All other services outside the scope of our current offerings will be reviewed and if doable, they are subject to different rates and fees and will be assessed on an individual case-by-case basis. They will be quoted upon request and the quotation will be submitted to the Client(s) for their review and approval before any work is initiated.

  16. UPGRADES/RENEWALS/AUTOMATIC BILLING:
    16.1 If your [Client] lifestyle needs or situation should change, you can switch to a different monthly or annual package, program or plan at any time by notifying us in writing with a minimum of one weeks' notice. The new plan would take effect and commence at the start of the next month (or monthly billing cycle) and will be billed accordingly. Please note that unused hours, credits or requests from the original package, program, or plan will not be refunded, nor will they be banked, rolled over, accrued, or accumulated to the following month, nor can they be credited or transferred to a different service package, program, or plan, nor can they be gifted, shared, or transferred to a third party.
    16.2 Your monthly or annual program, package or plan will automatically renew at the beginning (first day) of each month and you will be automatically billed. You will not be notified of the renewal. Therefore, you consent and allow Contessa Concierge & Personal Assistant Services to charge your credit card each month without contacting you in any way, unless you are paying by another pre-approved method of payment, or if you notify us to cancel your account and/or service plan. You are eligible to upgrade or downgrade your account or service plan at any time. The new plan would take effect and commence at the start (1st) of the next month (or monthly billing cycle) and will be billed accordingly.
    16.3 If you are enrolled in an annual program, package or plan, it will automatically renew before the last day of the actual expiry date of your annual program, plan or package. (or the last day of the 12th month that your annual plan expires). During the year, your monthly payment will be processed on the beginning (first day) of each month. You will not be notified of the annual renewal or the processing of the monthly fee. Therefore, you consent and allow Contessa Concierge & Personal Assistant Services to charge your credit card each month without contacting you in any way, unless you are paying by another pre-approved method of payment, or if you notify us to cancel your account and/or service plan. Unless we receive written notification from you [Client] before the end of your annual cycle or year-end expiry date for your annual program, package or plan, it will be automatically renewed for another year. You are eligible to upgrade or downgrade your account or plan at any time with a minimum of one weeks' notice, in writing. The new plan would take effect and commence at the start (1st) of the next month (or monthly billing cycle) and will be billed accordingly.

  17. CANCELLATION AND TERMINATION:
    17.1 You may cancel your account and Services with us at any time by following the provisions, terms and instructions noted below, and by emailing info@contessaconcierge.com for further instructions from us.
    17.2 Upon termination of the account and/or Services by either party for any reason:
    Contessa Concierge & Personal Assistant Services will cease providing you with Services, and your account will be closed/cancelled/deactivated.
    Unless otherwise indicated in the Terms and Conditions and/or Service Agreement, you will not be entitled to any refunds of any fees, pro rata or otherwise.
    Any outstanding balance owed to Contessa Concierge & Personal Assistant Services for services rendered through the effective date of such terminations will immediately become due and payable in full.
    17.3 Cancellations of pre-paid monthly or annual programs, packages and plans are subject to review and must be requested in writing prior to the next monthly billing cycle, with a minimum of one weeks' notice. Should you cancel any time after the 1st day of your renewed monthly or annual plan cycle, you will be billed for that month. If you sign up for a program, plan or package and want to cancel in the same month, you will not be eligible for a refund. We will bill you for that month, or the month in which you notified of us of your intention to cancel or date that you provided giving us final notice of cancellation, and we will cancel your membership thereafter and ensure that your Service plan no longer renews and that no further charges are applied after the month you cancelled. For any reason, if you want to terminate your account, please email us at info@contessaconcierge.com for further instructions on how to cancel your service plan. 
    17.4 A minimum 24-hour notice is required for cancellation of regular services and/or À La Carte Services, pay-as-you-go services, hourly services, hourly rates, ad hoc service requests, services by special request, one-off services or Specialty Services. A cancellation charge may be levied for cancellations with less than 24 hours notice.
    17.5 Contessa Concierge & Personal Assistant Services reserves the right to modify and terminate all Services, including regular services and/or À La Carte Services, pay-as-you-go services, hourly services, hourly rates, ad hoc service requests, services by special request, one-off services or Specialty Services as well as packages, programs and plans due to late payments or non-payments, and/or for any other reason.

  18. REFUNDS AND CREDITS:
    18.1 No refunds of any fees, pro rata or otherwise, or credits will be issued for services rendered.
    18.2 Pre-paid monthly or annual service packages, programs and plans may be cancelled at any time by giving us a minimum of one weeks' written notice. Please note that they are all non-refundable and non-transferable. Upon receipt and review of the Client's written notice to cancel their monthly or annual program, package or plan, the current month in which we are notified of your intent to cancel will be billed in full for services accordingly. Your monthly or annual program, package or plan will then be cancelled at the end of that month and you will no longer be billed for subsequent months thereafter.
    18.3 There will also be no refunds for any goods and services reserved, booked and/or purchased on the Client(s) behalf under any circumstances. When you ask Contessa Concierge & Personal Assistant Services to book, schedule or reserve services and/or make purchases on your [Client's] behalf, we will not be held accountable, responsible or liable if the goods or services do not meet the client's expectations in any respect, or if the client should change their mind and wish to cancel the order for goods and services. Please review all customer service, refund and exchange policies of the service providers, suppliers, merchants, retailers, wholesalers, sellers, resellers and/or vendors with which you intend to do business with, or make a purchase from, and that you have requested that we execute the purchase(s) and/or procure the goods and services on your behalf, prior to submitting the service request to us. We will not be held accountable, liable or responsible in any way for purchases on your behalf that are lost or damaged during shipping or in transit, for tickets arriving late, etc. We will make purchases on your behalf in order to fulfill a service request, but we will not be responsible for the goods or services we are purchasing.
    18.4 For pre-paid monthly or annual programs, packages and plans, any hours, credits or requests that are not used within the month, or within 30 days, for any reason, will not be refunded, nor will they be rolled over, accrued, banked or accumulated to the following month, nor can they be transferred or credited to a different service package, program, or plan, nor can they be gifted, shared or transferred to a third party.

  19. ADDITIONAL SERVICES/OVERAGES:
    19.1 If a Client(s) requires or utilizes additional hours or services that are not within the scope of, or are above and beyond what is included in their current pre-paid package, program, or plan, they can choose to purchase additional services at an hourly rate. They will be handled separately in consultation with the client. They must be paid immediately upon receipt of invoice for services rendered. Please note that Specialty Services will be subject to a different rate, fee or cost structure. This will be discussed with the client prior to initiating the work or service request.

  20. PURCHASED ITEMS AND THIRD-PARTY EXPENSES & SERVICES:
    20.1 The cost of purchased items, goods and services and/or third party expenses and services is not included, and they are to be paid in full by the Client in advance of the service request or work being undertaken.
    20.2 At the Client(s) or User's request, Contessa Concierge & Personal Assistant Services may purchase items either in person, or over the Internet or on the phone with third-party vendors or a merchant or seller with the User's/Client(s) credit card. In the event that the User/Client(s) initially wants Contessa Concierge & Personal Assistant Services to make purchases for the User/Client, the User/Client will be asked for a credit card to be used for those charges. Such authorization may be given in writing. Any request to make purchases over $250 must be submitted for approval in advance by email or other written authorization to Contessa Concierge & Personal Assistant Services. Contessa Concierge & Personal Assistant Services shall not purchase any item on behalf of the Client from a third party, vendor, store or merchant, retailer, wholesaler, seller or reseller unless first authorized to do so by the User or Client(s). Contessa Concierge & Personal Assistant Services does not warrant or guarantee or stand behind any purchases made on the User's or Client(s) behalf. Contessa Concierge & Personal Assistant Services is merely acting to facilitate the purchase on the Client's behalf and all disputes with goods and services and/or charges need to be addressed directly to your [Client's] Credit Card Company or vendor, store or merchant, retailer, wholesaler, seller or reseller, etc. All invoices, shipping information, etc. will be sent directly to the User's or Client(s) email address from the third party vendor, store or merchant, retailer, wholesaler, seller or reseller.
    20.3 All Rates including À La Carte Services, hourly services or hourly rates, or services by special request, and any service packages, programs, and plans and Specialty Services do NOT include charges for third-party vendors, consultants, contractors, sub-contractors, sub-trades, installers, suppliers, or any other service providers to complete the service request(s). These costs are the responsibility of the Client(s) and they are to be paid in full by the Client(s) according to the terms and conditions set forth in the vendor's or seller's contract and/or purchase order, or purchasing agreement. These costs may include, but are not limited to, the cost of the work to be done, any deposits, down-payments, costs for the materials, parts and labour costs, expenses and fees, permits, any other products and services, and costs to pay sub-trades, suppliers, and all applicable taxes.
    20.4 All Rates including À La Carte Services, hourly services or hourly rates, ad hoc services, pay-as-you-go services, services by special request, and any service packages, programs, and plans and Specialty Services do NOT include the cost of purchases such as products, merchandise, items, materials, goods and services, applicable taxes, or other related expenses, fees or charges incurred while executing service requests on behalf of the Client(s). These costs are the responsibility of the Client(s) and they are to be paid in full by the Client(s) prior to the work or service request being initiated.
    20.5 Certain services, for example, such as event planning, production, project management, home management services, or renovation projects may require a pre-payment, advance payment, down-payment or deposit prior to initiating the work, project, installation, repairs, event, or service request. The deposit/down-payment shall be paid in full by the Client(s) as well as any further partial payments or deposits, and the final balance and payment owing to the third party vendor/supplier/contractor, where applicable, as per the terms and conditions of the vendor's/contractor's/supplier's contract and as outlined in the contract's payment schedule, and terms of payment.
    20.6 Contessa Concierge & Personal Assistant Services shall contract with others, including third-party vendors, contractors, suppliers, etc., as needed and in consultation with the Client(s), to provide the services requested. Contessa Concierge & Personal Assistant Services shall use their best efforts to obtain qualified providers of such services, but no guarantee or warrantee is given as to the quality and standards, efficacy and safety standards of products and/or services provided by others. Contessa Concierge & Personal Assistant Services is not responsible or liable for any dissatisfaction of purchases by Client(s) from third party vendors, suppliers, consultants, contractors, sub-contractors, trades, sub-trades, merchants, stores, and any other service providers.
    20.7 Client(s) understands and agrees that Contessa Concierge & Personal Assistant Services shall not be liable or responsible in any manner for any losses, damages or claims that arise from the furnishing of services to Client(s) by any contractor, subcontractor, sub-trade, third-party vendor or supplier, merchant, store, or any other seller or service provider, including any consequential damages that may arise from the furnishing of such services.
    20.8 Where applicable, Contessa Concierge & Personal Assistant Services shall use all reasonable endeavours to monitor the products, goods and/or services provided by service partners, service providers, suppliers, third-party vendors, etc. but we cannot accept responsibility for any losses, liabilities, costs or damages or extra charges incurred by you as a result of any acts or omissions of service partners nor can we guarantee or warrantee the accuracy, timeliness, validity, completeness, and reliability of information supplied to you by service partners. No guarantees or warrantees can be given on behalf of any service partners, service providers, vendors or suppliers. You shall require seeking compensation for any loss or damage suffered directly from the service partner, service provider, supplier or third-party vendor.

  21. TRAVEL AND TRANSPORTATION ARRANGEMENTS & HOLIDAY PLANNING:
    21.1 Travel and transportation arrangements, including holiday and vacation planning, are also offered as part of our services. Contessa Concierge & Personal Assistant Services will try to find you the best deal for air travel, hotel accommodations, car rentals, limo services, etc. based on your criteria and requirements. We will not be responsible in any way and do not represent the quality nor can we guarantee or vouch for any of these service providers. As the Client, you are responsible for the review, selection and final approval of your destination and/or service provider(s) or operator. If you are not satisfied in any way with any services referred to you, please contact the service provider or operator directly rather than Contessa Concierge & Personal Assistant Services. Once we book, place an order or make a purchase for flights, hotels, or any other travel-related services on your behalf, we will not be held responsible or liable for any refunds, exchanges, credits, or disputes. It will be your responsibility to enquire about the service provider or operator's cancellation policies, customer service policies, and/or dispute-resolution policies prior to booking, and to deal with any concerns, complaints or issues you may have directly with the service provider or operator. Contessa Concierge & Personal Assistant Services will not refund, credit or be held liable or responsible whatsoever for any travel- or transportation-related purchases, arrangements or services.

  22. TEXT MESSAGING:
    22.1 During the course of carrying on business or executing or fulfilling a service request for a Client(s), Contessa Concierge & Personal Assistant Services may offer to text you, or vice versa, the information you are requesting or for other reasons or communication purposes. Please note that standard message and data rates may apply. Check with your carrier or mobile provider if you have any questions about your cell phone plan and costs. Contessa Concierge & Personal Assistant Services will not reimburse you nor will we be responsible or liable for your text message or other long-distance or phone charges.

  23. PRIVACY:
    23.1 The security and privacy of your personal information is important to us, but please note that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.
    23.2 Contessa Concierge & Personal Assistant Services takes pride and the utmost care in protecting, respecting and maintaining the confidentiality, security, and privacy of our clients. All personal information and credit card information obtained is gathered for the purpose of providing concierge services and/or personal assistant services, project management, specialty services and other related services, as well as for billing the Client for services rendered, or to pay for purchases or services on behalf of the Client. Under no circumstances will the collected information be disclosed to a third party, except for the purpose of completing the Client's financial obligation to Contessa Concierge & Personal Assistant Services.
    23.3 Sensitive personal client information will be handled in a confidential and appropriate manner. All personal information, as well as credit card information, obtained and entrusted to Contessa Concierge & Personal Assistant Services, except as permitted or required by law, and in accordance with all municipal, provincial and federal legislation, will never be shared, released, disclosed, rented, bartered or sold to third parties, or without the consent of the Client(s). Information collected will be used solely by Contessa Concierge & Personal Assistant Services to proactively anticipate and/or provide high-quality services and programs that best meet our Clients’ needs, to evaluate the quality of services, and for communication purposes with our Clients.

  24. LIMITATIONS:
    24.1 By agreeing to our terms, you realize that there are inherent limitations to the services we are to provide. We will not make illegal purchases on your behalf or represent you in any unlawful or illegal way. For purchases made on your behalf, Contessa Concierge & Personal Assistant Services, its owners and (as applicable) its employees and independent contractors will NOT be held accountable, liable or responsible for returns, exchanges, credits, refunds, cancellations, or guarantees on behalf of the products, items, and goods and services you are purchasing. We will take all the necessary precautions to protect your information, but we will not be held responsible, accountable or liable for any reason whatsoever should your information become exposed or compromised, or if you are not pleased with the products or services you approved for us to purchase and charge on your behalf. Contessa Concierge & Personal Assistant Services will not lie on your behalf for any reason or be involved, connected or responsible for any of your personal, business, financial, or other activities and actions. 

  25. LIMITATION OF LIABILITY
    25.1 In no event will Contessa Concierge & Personal Assistant Services and (as applicable), any of its owners, partners, affiliated parties, content providers, including their respective officers, directors, employees, independent contractors, publisher, editors, content contributors, webmaster, agents, licensors or representatives, be responsible or liable for any direct, indirect, incidental, special, consequential, punitive, extraordinary, exemplary, or compensatory or damages resulting from loss of profits, lost data or business interruption arising out of the use, inability to use, or the results of use of the Sites and Service.
    25.2 Recommendations of third-party vendors and suppliers are at your own risk and Contessa Concierge & Personal Assistant Services shall not be held responsible or liable for any dissatisfaction from any product, service or merchandise. The decision to use any third-party service vendor, contractor, sub-contractor, trade, sub-trade, service provider, seller, reseller, merchant, retailer, store, wholesaler or supplier is your responsibility, and is only a recommendation by Contessa Concierge & Personal Assistant Services and holds no guarantees for satisfaction. Any complaints, refunds, returns, exchanges, etc. should be directed to the specific vendor or service provider or seller and not to Contessa Concierge & Personal Assistant Services. The concierges' comments and recommendations presented are based on research and opinions collected by the concierge(s), and are subject to change at any time. In addition, all responses will be provided based upon reasonable research and efforts on behalf of us. We do not recommend utilizing our services for financial, legal, tax, medical, health, or other sensitive matters.
    25.3 If Contessa Concierge & Personal Assistant Services and (as applicable) any of its affiliated parties, staff, independent contractors, content providers, contractors, partners, third-party vendors, suppliers, or other service providers is unable to complete an errand by an act of God or an unforeseen event, the liability to perform the errand will be excused, and rescheduled at our earliest convenience.

  26. INDEMNIFICATION
    26.1 You agree to indemnify, defend and hold harmless Contessa Concierge & Personal Assistant Services, and its owners, partners, service providers, affiliated parties, and (as applicable) each of their subsidiaries, affiliates, officers, directors, beneficiaries, members, partners, employees, independent contractors, content providers, publisher, content contributors, editors, webmaster, consultants, attorneys, licensors and agents and their respective successors and assigns, if any, (collectively the "Indemnified Parties") from and against all claims, actions, losses, liabilities, damages, costs and expenses (including, but not limited to, attorney's fees and expenses) arising from, or related to or associated with your use of our Sites and our Services. 

  27. DISCLAIMER: HEALTH, LIFESTYLE & FITNESS DISCLAIMER
    27.1 CONTESSA CONCIERGE & PERSONAL ASSISTANT SERVICES IS NOT RESPONSIBLE FOR ANY ACTION TAKEN AS AS A RESULT OF THE INFORMATION PROVIDED ON OUR WEBSITE, BLOG, AND ANY OTHER PLATFORMS OR SITES OR SERVICE.
